Please read these Terms of Service (“Terms”) carefully before using White Pod Collections (“the Service”). By creating an account or using the Service you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Service you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
White Pod Collections is a web-based application that allows users to catalogue physical collectibles, track acquisition costs and current valuations, manage wishlists and for-sale listings, and generate portfolio reports.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Upload content that infringes any third-party intellectual property rights
- Use automated means to scrape, crawl, or extract data from the Service
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
5. Content and Data
You retain ownership of all content you upload to the Service, including item descriptions, photographs, and valuation data. By uploading content you grant us a limited, non-exclusive licence to store and display that content solely for the purpose of providing the Service to you.
We do not sell, rent, or share your collection data with third parties except as described in our Privacy Policy or as required by law.
6. Valuations and Financial Information
Valuations recorded in the Service are for personal tracking purposes only. They do not constitute professional financial, insurance, or appraisal advice. We make no representations about the accuracy or completeness of any valuation data. You should consult a qualified professional for insurance or tax purposes.
7. Availability and Changes
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We may update these Terms periodically; continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
8. Data Export and Account Deletion
You may export a copy of your data at any time via the Settings page. You may delete your account at any time, which will permanently remove your data from our systems within 30 days, except where retention is required by law.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
11. Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
